Terms

Terms of service

The deal between you and us: what you can do with SimplCarz, what you cannot, and what each of us is on the hook for. Short version — it is yours to use for your own cars, and yours alone to use.

1. Who these terms are with

SimplCarz is operated by July Industries, company number 16290659, registered at Unit A, 82 James Carter Road, Mildenhall, United Kingdom, IP28 7DE. Where these terms say “we” or “us”, that is who they mean. Where they say “the app”, that means the SimplCarz mobile app and this website together.

Reach us about anything in these terms at support@julyindustries.com.

2. Agreeing to these terms

Creating an account or using the app means you accept these terms. If you do not accept them, do not use it.

You need to be at least 16 to hold an account. If we change these terms in a way that materially affects you, we will tell you by email before the change takes effect, and continuing to use the app after that means you accept the new version. The date at the top of this page moves whenever the substance changes.

3. Your account

Keep your password to yourself and keep it to your own account — accounts are for one person and are not to be shared, sold or passed on. Tell us at support@julyindustries.com if you think someone else has got into yours.

You are responsible for what happens under your account, and for the accuracy of what you put into it. We do not check whether the service records you enter are correct.

4. What you may and may not do with the app

We give you a personal, non-exclusive, non-transferable, revocable licence to use SimplCarz to keep records for vehicles you own or operate. That includes vehicles you run for your own business — a van, a fleet of them, the cars on your own drive.

What the licence does not allow is making money out of the app itself. You may not:

  • Sell, resell, sublicense, rent, lease, lend or otherwise transfer the app, your account, or access to either, whether or not you charge for it.
  • Charge anyone for access to it, or for use of it on their behalf, or bundle it into a service you sell.
  • Rebrand, white-label or pass it off as your own product or as part of one.
  • Copy, adapt, decompile, reverse engineer or otherwise try to extract the source, or build a competing or derivative product from it or from anything you learn by taking it apart.
  • Scrape, bulk-export or systematically extract data from it, other than your own records, or use automated means to access it.
  • Advertise in it, or exploit it commercially in any other way we have not agreed in writing.

Nor may you use it to break the law, to infringe anyone else’s rights, to upload anything unlawful or malicious, or to interfere with the service or with anyone else’s use of it.

If you want to do something commercial with SimplCarz, ask — support@julyindustries.com. The answer is not automatically no, but it has to be a written agreement rather than an assumption.

5. Who owns what

Your records are yours. The service history, mileages, costs, photos of receipts and documents you put into the app belong to you. We do not claim ownership of them and we do not sell them.

You give us only the permission we need to run the service for you: to store your records, back them up, and show them back to you on your devices. That permission ends when you delete the records or close your account.

The app is ours. The software, the name, the logo, the design and everything else that makes up SimplCarz stays our property. Nothing in these terms hands any of it over.

If you send us feedback or a feature idea, we may act on it without owing you anything for it. That is not us taking your work — it is so that a good suggestion does not create a claim over the thing we build next.

6. SimplCarz Plus

The app is free to use, and stays that way for one vehicle. A complete record of that vehicle — every job, photo, receipt and document you enter, your full history, and MOT reminders — costs nothing and always will.

SimplCarz Plus is an optional subscription. It adds the things the app works out for you rather than the things you type in: service due dates and mileage projections, tax and insurance reminders, the interval health and service cadence charts, and more than one vehicle.

Price.£19.99 per year, or £2.99 per month. Prices are shown in your App Store’s currency before you confirm, and that figure is the one you pay.

Free trial. New subscribers get 7 days free. If you cancel before the trial ends you are not charged. If you do not cancel, the subscription begins and the first payment is taken at the end of the trial.

It renews automatically. Your subscription renews for the same period, at the same price, and your Apple Account is charged within 24 hours before the current period ends, unless you cancel at least 24 hours before that point.

How to cancel. Manage or cancel in Settings → your name → Subscriptionson your device, or in the App Store app under your account. We cannot cancel a subscription for you, because Apple holds the billing relationship — but cancelling there is immediate and needs nothing from us. Cancelling stops the next renewal; it does not shorten the period you have already paid for.

Payment and refunds are handled by Apple. We never see or hold your card details. Purchases are governed by the Apple Media Services Terms and Conditions as well as these terms, and refunds are at Apple’s discretion — request one at reportaproblem.apple.com. If you believe something has gone wrong, contact us anyway and we will help where we can.

If your subscription ends. Nothing you have entered is deleted, hidden or locked. Every record, photo and document on every vehicle stays visible and exportable. What stops is the working-out, and the ability to add a second vehicle. If you have more than one vehicle when a subscription lapses, they all remain readable and one stays editable.

Changes to pricing. If we change the price of an existing subscription, Apple will tell you and ask you to agree before it takes effect. A price you have already been charged does not change retrospectively.

7. Availability

We will do our best to keep the app running and your records intact, but we do not promise it will always be available or always be error-free. Parts of it depend on services we do not control, and it will occasionally be down for maintenance.

We may change or withdraw features. If we discontinue the service altogether, we will give you reasonable notice and a way to get your records out first.

8. Reminders are a convenience, not a legal safety net

SimplCarz tells you when an MOT, insurance renewal, road tax or service looks due, based on what you have entered and on the intervals you set. It is a reminder tool, and reminders can be wrong — a mistyped date, a notification that never arrives, a phone that was off.

Keeping your vehicle taxed, insured, MOT’d and roadworthy remains your responsibility. Do not rely on the app as your only check, and do not treat anything in it as legal, mechanical or financial advice.

9. Ending it

You can stop using the app whenever you like, and ask us at support@julyindustries.com to delete your account and everything in it.

We may suspend or close your account if you break these terms — in particular section 4 — or if we have to in order to comply with the law. Where it is reasonable to do so, we will warn you first and give you a chance to put it right.

10. Our liability

Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit. If you are a consumer, you keep all of your statutory rights, and nothing in these terms takes them away.

Beyond that, we are not liable for indirect or consequential loss, for lost profits or business, or for a fine, penalty or cost you incur because a reminder did not reach you or was wrong — see section 8. Our total liability to you is limited to the greater of the amount you have paid us in the twelve months before the claim, or £100.

11. Your data

What we collect and why is in the privacy notice, which forms part of these terms.

12. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK, you may also bring proceedings in your own courts.

If a court finds part of these terms unenforceable, the rest stays in force. If we do not enforce something straight away, that is not us giving it up.
